DE B.I.C., identified with RUC No. 20434819165, with address at Avenida Caminos del Inca No. 390 Office 901, Urbanization Tambo de Monterrico, district of Santiago de Surco, province and department of Lima (hereinafter, “EBS”), guarantees the adequate reservation and protection of personal data that is provided voluntarily when establishing a relationship with EBS, ensuring respect for the privacy and confidentiality of such data.

EBS will guarantee the confidential treatment of the personal data that you provide on a voluntary basis, observing at all times the security measures and guarantees provided for in Law No. 29733, Personal Data Protection Act, and its Regulations approved by Supreme Decree No. 016-2024-JUS (hereinafter, the “Personal Data Protection Regulations”). As a result, your data will be managed by EBS exclusively for the purposes set out in this document.

I. Authorization for Use of Personal Data

EBS will guarantee the confidential treatment of the personal data that you provide on a voluntary basis, observing at all times the security measures and guarantees provided for in Law No. 29733, Personal Data Protection Act, and its Regulations approved by Supreme Decree No. 016-2024-JUS (hereinafter, the “Personal Data Protection Regulations”). As a result, your data will be managed by EBS exclusively for the purposes established in this document. The authorization gives EBS the power to process all personal data that you provide or that are generated, for a period of up to three (3) years after the conclusion of the contractual relationship, except for those data whose conservation is mandatory in accordance with applicable regulations.

In addition, when you have provided your consent to the processing of data for additional purposes, EBS may use that information indefinitely, until such consent is expressly revoked.

In relation to complaints and/or complaints made through the EBS Complaint Books, the corresponding information will be kept for a period of three (3) years, in compliance with consumer protection regulations.

III. Purposes of Personal Data Processing

The personal data collected by EBS will be processed for the following purposes:

  1. “Customers” Personal Data Bank:
    • Establish and maintain communication with clients to provide information about legal and other services offered by EBS.
    • Submit content of a general legal nature that may be relevant or of interest to customers.
    • Disseminate and send informational or promotional communications, such as newsletters, invitations to events or publications linked to the study's services, provided that the owner has given his express consent.
  2. Personal Data Bank “Workers”:
    • Collect the personal data of workers to carry out human and administrative resource management; as well as to comply with work obligations.
  3. “Providers” Personal Data Bank:
    • Collect and process personal data from service providers to fulfill the professional or contractual relationship.
  4. “Applicants” Personal Data Bank:
    • Manage and develop the recruitment and selection processes of EBS personnel.
    • Retain applicants' information for future employment opportunities, with the applicant's specific consent.

EBS will store the information collected for as long as necessary to fulfill the purposes described below, and will securely delete or anonymize your information once that purpose has disappeared or the storage period has expired, in accordance with the Personal Data Protection Regulations.

EBS recognizes your right to object to the processing of your personal data when you consider that the information provided is not related to the above-mentioned purposes or when it is not necessary for the conclusion or execution of a contractual relationship. This is without prejudice to your right to revoke the previously granted consent at any time or to exercise your right of opposition in accordance with applicable regulations.

ARCO rights constitute a set of powers aimed at ensuring the protection and proper management of personal data, allowing you to maintain control over your information. The Personal Data Protection Regulations recognize these rights to ensure that the processing of your data is carried out properly.

The deadline for response to Rectification, Cancellation and Opposition requests is ten (10) business days, while Access requests will be answered within a maximum period of twenty (20) business days.

If you consider that you have not been properly addressed in the exercise of your ARCO rights by EBS, you can file a complaint with the National Authority for the Protection of Personal Data (ANPDP), by contacting the Bureau of Parties of the Ministry of Justice and Human Rights located at Calle Scipión Llona No. 350, district of Miraflores, province and department of Lima.

V. Amendments to the Privacy Policy

EBS is entitled to revise, modify or update this Privacy Policy at any time, unilaterally and discretionally, without the need for prior communication, in compliance with the Personal Data Protection Regulations.
